Lyneer Staffing Solutions LLC, its subsidiaries and affiliates (the “Company” or “we” or “us”) are committed to protecting the privacy of certain data that is collected from you and that you submit when you access this website (the “Site”) and in other circumstances described in this Policy. In general, our processing of personal information is designed to improve the purchasing experience of our customers and to provide relevant information about our products, services, and promotions.
About the Policy
This Privacy Policy (“Policy”) describes our policies and practices regarding the collection, use and disclosure of personally identifiable information you submit, or we obtain in connection with your use of this Site, and in other circumstances with respect to California residents. Please read this Policy carefully before using the Site or submitting information to us. If you are applying for a job with The Company, please also see our Applicant Privacy Statement which contains additional information. By accessing or visiting the Site, you indicate your understanding that the collection, use, and sharing of your information is subject to the terms of this Policy and our Terms of Use. If you do not consent to the collection, use, and sharing of your information as described in this Policy, please do not provide us with such information.
Changes to this Policy
We reserve the right to amend this Policy at any time without advance notice in order to address future developments of Company, the Site or changes in industry or legal trends. We will post the revised Policy on the Site or announce the change on the home page of the Site. You can determine when the Policy was revised by referring to the “Last Updated” legend on the top of this Policy. Any changes will become effective upon the posting of the revised Policy on the Site. By continuing to use the Site following such changes, you will be deemed to have agreed to such changes. If you do not agree with the terms of this Policy, in whole or part, you can choose to not continue to use the Site.
Information We Collect
As described below, Company may collect or has collected in the preceding 12 months the following categories of personal information. For each category, we have set forth the purposes for which the category of personal information may be collected and used

• As necessary or appropriate to protect the rights, property, security, and safety of us, our employees, our customers, our information systems, and the public.
• To respond to law enforcement requests and as required by applicable law, court order, governmental regulations, or other lawful processes.

Geolocation data.
Audio, electronic, visual, thermal, olfactory, or similar information. Examples include photographs and videos of you. • To engage in marketing activities, including to provide you with information, products or services that you request from us.

Sources of Personal Information
The Company may add to the categories of personal information it collects and the purposes it collects and uses personal information. In that case, we will inform you. The categories of sources of personal information are described below. The examples provided are for illustration purposes and are not exhaustive.
• You. Examples of when we collect that information include:
o During a website visit or completed form, or when you visit us at one of our offices, locations, or events.
o If you upload or share a photo, submit a request, submit information, or post other digital content through one of our websites, applications or via social media interactions on third party websites like Facebook, Instagram, Linkedin or Twitter.
o If you register for a referral program.
o If you participate in a sweepstake, contest, promotion, program, clinic or workshop

o In connection with your interactions with us as a registered user of our websites
o We may use tracking tools like browser cookies, flash cookies, and web beacons. Please see the “Our Tracking Techniques” section below for more information.

• Your friends and family, such as when they provide your information through referrals. Persons who share such information in connection with those features or programs should only submit email addresses of individuals with whom they have a close personal or family relationship, who would be interested in receiving the communication, and who have authorized the sharing of their email address

Sharing Information
The above categories of personal information are shared with the following categories of third parties. The examples provided are for illustration purposes and are not exhaustive.
• Our employer clients. For example, we might share information with one of our employer clients who you may be applying for a job position. The use of your information by the employer customer will be subject to the privacy policy of that company, and the Company is not responsible for that company’s use of your information. You should review the privacy policy of the employer customer to ensure that you are comfortable with how it intends to use and disclose your information.

• Third parties who perform services on our behalf. For example, we share information with our certain service providers, including marketing companies, professional service providers, debt collectors, information service providers, and data storage companies. We might also authorize our service providers to collect information on our behalf. We might also share information with the vendors and manufacturers of our products and services to respond to your reviews and questions.

• Governmental entities, legal service providers. We may share your personal information in order to comply with the law. For example, we will disclose information to respond to a court order or subpoena. We may also disclose information if a government agency or investigatory body files a request.

• Successors to all or portions of our business. If all or part of our business is sold, we may disclose personal information in preparation for or as part of that transaction.

We do not sell your personal information, including any information concerning minors under age 16.
Your Privacy Preferences
You can register or change your preferences to receive or not receive marketing communications from us by emailing us. Please allow sufficient time for your preferences to be processed. Even if you opt out of receiving marketing messages, we may still contact you for transactional purposes like confirming or following up on an order or service request, responding to customer service inquiries, asking you to review a product or service you have ordered, or notifying you of product/service rebates. If, in the future, you do indeed want to receive marketing communications from us we will remove your information from our opt-out database.

Our Sites and Children
Our websites and device applications are not created for or directed to children. To our knowledge, we do not collect information online from children under 18. If you are a parent or guardian and think we have information about your child, please email hr@lyneer.com.
Safeguarding of Information
No system for safeguarding personal or other information is 100% secure and even though we have taken steps to protect your personally identifiable information from being intercepted, accessed, used or disclosed by unauthorized persons, we cannot fully eliminate security risks associated with personal information. However, we take a number of steps to safeguard the security of personally identifiable information obtained through the Site. For example, we maintain administrative, technical and physical controls to reasonably safeguard data from unlawful use, unauthorized access or disclosure. Additionally, we use Secure Socket Layer (SSL) data encryption when data is transmitted over the Internet to our Site. Individuals who have access to confidential and otherwise nonpublic data are required to maintain the confidentiality of such information.

Our websites contain links to third party websites. If you click on one of those links, you will be taken to websites we do not control. This Privacy Policy does not apply to the information practices of those websites. You should carefully read the privacy policies of other websites. We are not responsible for third party websites.
Social Media Plugins
This Site may use social media plugins (e.g. Facebook, Twitter, Instagram) to enable you to easily share information with others. When you visit our Site, the operator of the social plugin can place a cookie on your computer, enabling that operator to recognize individuals who have previously visited our Site. If you are logged into the social media website (e.g. Facebook, Twitter, Instagram) while browsing our Site, the social plugins allow that social media website to share data about your activities on our Site with other users of their social media website. For example, Facebook Social Plugins allow Facebook to show your Likes and comments on our pages to your Facebook friends. Facebook Social Plugins also allow you to see your friends’ Facebook activity on our website. We do not control any of the content from the social media plugins. For more information about social plugins from other media websites you should refer to those sites’ privacy and data/information sharing statements/policies.
Our Tracking Activities
We collect personal and other information about users over time and across different websites and devices when you use this Site or service. We also have third parties that collect personal information this way. We, or our vendors, use several common online tracking tools to collect this information. These may include browser and flash cookies. We may also use web beacons and similar technologies. We or third parties may also collect or receive information from our device applications and others’ device applications and use that information to provide measurement services and targeted ads. We (and our third-party service providers) also use these tools:
• To track new visitors to our websites
• To recognize returning customers
• To learn what site referred you to our website or device application
• To personalize your experience on our website, device application and on third-party social networking websites, plug-ins and applications
• To collect and store geographic data determined by the IP address of your computer
• To optimize and tailor our websites and device applications
• To make product recommendations and provide you with advertising content we believe may be of interest to you. As part of this customization, we may observe your behaviors on our device applications, our websites or on other websites. We may also get information about your browsing history from our trusted business partners and vendors
• So we can better understand our audience, our customers, our website visitors and device application users, and their respective interests, which includes learning about your online activities across devices

Controlling Our Tracking Tools. Your browser may give you the ability to control cookies, and add-ons may allow you to decide which cookies to activate/deactivate. How you do so depend on the type of cookie. Certain browsers can be set to reject browser cookies. To control flash cookies, click here. Your device may not give you the ability to control cookies. If you configure your computer to block cookies, you will limit the functionality we can provide when you visit our websites. If you configure to block or delete cookies, not all of the tracking that we have described in this policy will stop.

Our “Do Not Track” policy. Some browsers have a “Do Not Track” feature that lets you inform websites that you do not want to have your online activities tracked. These browser features are not uniform, so we are not currently set up to respond to those signals.
Controlling Online Interest-Based Ads. We sometimes work with online advertising vendors to provide you with relevant and useful ads. This may include ads served on our websites or device applications. This may also include ads served on other company websites. These ads may be based on information collected by us or third parties. For example, information a third party collects when you register for a website: e.g. your zip code. This might be used to target an ad for people in your area. These ads may also be based on your activities on our websites or on third party websites.

To learn more about interest-based ads and to opt out of certain types of interest-based advertising and certain other uses of information collected over time and across different online services and devices, click here. To opt out of certain interest-based advertising associated with your use of device applications, you may be able to adjust your device settings via the “Limit Ad Tracking” setting for iOS devices or the Android “Opt out of Ads Personalization” setting for Android devices. Please see the support materials for your operating systems or devices for more information.

Some of the social media platforms we work with may serve you with interest-based advertising on their platforms. In addition to or instead of the opt-out mechanism linked above, you may be able to opt out of their interest-based advertising by changing your advertising preferences in the platforms after you log in.
Applicable law
This Policy is governed by the internal substantive laws of the State of California, without regard to its conflict of laws principles. Jurisdiction for any claims arising under or out of this Privacy Policy shall lie exclusively with the state and federal courts within the State of Delaware. If any provision of this Policy is found to be invalid by a court having competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of this Policy, which shall remain in full force and effect.
Notice to California Residents
California Residents
This section of the Privacy Policy (“CA Policy”) supplements and amends the information contained in our Privacy Policy with respect to California residents. This CA Policy applies solely to individuals, visitors, users, and others who are natural persons and residents of the State of California (“consumers” or “you”). THIS ADDENDUM TO THE PRIVACY POLICY DOES NOT APPLY TO USERS WHO ARE NOT NATURAL PERSONS AND NOT CALIFORNIA RESIDENTS.
The CA Policy describes Company’s policies and practices regarding the personal information we collect, use, and disclose about you, including personal information you submit, or we obtain when you access the Site, as well as certain other personal information relating to you. This CA Policy is adopted in part to comply with the California Consumer Privacy Act (“CCPA”).
Any terms defined within the CCPA have the same meaning when utilized within this CA Policy. The other provisions of the Privacy Policy continue to apply except as modified in this CA Policy. Note, however, that personal information as used in this CA Policy does not include:
• Personal information covered by the Health Insurance Portability and Accountability Act of 1996 (“HIPAA”), called “Protected Health Information”.
• Publicly available information from government records.
• De-identified or aggregated consumer information.
• Information excluded from the CCPA’s scope, such as personal information covered by certain sector-specific privacy laws, including the Fair Credit Reporting Act (FRCA), the Gramm-Leach-Bliley Act (GLBA) or California Financial Information Privacy Act (FIPA), and the Driver’s Privacy Protection Act of 1994.

Consumer Rights
Pursuant to the CCPA, and as detailed below, consumers have various rights with respect to their PI. The CCPA does not extend the following rights to PI collected from a business’s employees or job applicants if the PI is collected and used solely for such employment purposes. Additionally, CCPA does not extend the following rights to PI covered by HIPAA, called PHI.
• Request to Delete. You have the right to request that we delete your personal information from its records and direct any service providers to delete your personal information from their records, subject to certain exceptions. Upon receipt of a confirmed verifiable consumer request (see below), and as required by the CCPA, we will delete and direct any service providers to delete your personal information from its records.

Company is not required to comply with your request to delete your personal information if it is necessary for us (or its service provider) to maintain your personal information in order to:

1) Complete the transaction for which the personal information was collected, provide a good or service requested by you, or reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform a contract between the Company and you.
2) Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity; or prosecute those responsible for that activity.
3) Debug to identify and repair errors that impair existing intended functionality.
4) Exercise free speech, ensure the right of another consumer to exercise his or her right of free speech, or exercise another right provided for by law.
5) Comply with the California Electronic Communications Privacy Act pursuant to Chapter 3.6 (commencing with Section 1546) of Title 12 of Part 2 of the Penal Code.
6) Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when the Company’s deletion of the information is likely to render impossible or seriously impair the achievement of such research, if you have provided informed consent.
7) To enable solely internal uses that are reasonably aligned with your expectations based on your relationship with the Company.
8) Comply with a legal obligation.
9) Otherwise use your personal information, internally, in a lawful manner that is compatible with the context in which you provided the information.

Upon receipt of a confirmed verifiable consumer request (see below), and as required by the CCPA, we will provide a response to such requests.

If you are under the age of 18, and a registered user of any site where this CA Policy is posted, California law permits you to request and obtain removal of content or information you have publicly posted. You may submit your request using the contact information at the end of this Policy. Please be aware that such a request does not ensure complete or comprehensive removal of the content or information you have posted and that there may be circumstances in which the law does not require or allow removal even if requested.

• Request to Know. You have the right to request that we disclose the following to you as it relates to the 12-month period preceding its receipt of your verifiable consumer request:
1) The categories of personal information we have collected about you.
2) The categories of sources from which the personal information is collected.
3) The business or commercial purpose for collecting or selling personal information.
4) The categories of third parties with whom we share personal information.
5) The specific pieces of personal information we collected about you.

Upon receipt of a verifiable consumer request (see below), and as required by the CCPA, we will provide a response to such requests.

You have the right to request that we disclose the following to you as it relates to the 12-month period preceding our receipt of your verifiable consumer request:
1) The categories of personal information that we collected about you.
2) The categories of personal information that we disclosed about you for a business purpose.

Upon receipt of a verifiable consumer request (see below), and as required by the CCPA, we will provide a response to such requests.

In addition to the CCPA, California Civil Code Section 1798.83 permits you to request information regarding the disclosure of your personal information by certain members of Company to third parties for the third parties’ direct marketing purposes. Consumers who have provided their personal information to us may request information about our disclosures of certain categories of personal information to third parties for their direct marketing purposes. Such request must be submitted to us by calling (855) 459-6337 or reach us by email at hr@lyneer.com. Please mention in your call or email that you are making a “California Shine the Light” inquiry. Within 30 days of receiving such a request, we will provide a list of the categories of such personal information disclosed to third parties for third-party direct marketing purposes during the immediately preceding calendar year, along with the names and addresses of these third parties. This request may be made no more than once per calendar year. We reserve our right not to respond to requests submitted other than to the address specified in this paragraph.

• Nondiscrimination. We will not discriminate against you in violation of the CCPA for exercising any of your CCPA rights. For example, we generally will not provide you a different level or quality of goods or services if you exercise your rights under the CCPA.

We reserve the right to only respond to verifiable consumer requests. A verifiable consumer request is one made by any individual who is:
• The consumer who is the subject of the request,
• a consumer on behalf of the consumer’s minor child, or
• by a natural person or person registered with the Secretary of State authorized to act on behalf of a consumer.
If we request, you must provide us with sufficient information to verify your identity and/or authority to act on behalf of the consumer. In general, we may ask you to provide identifying information that we already maintain about you or we may use a third-party verification service. In either event, we will try to avoid asking you for sensitive personal information to verify your identity. We may not be able to respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you. However, making a verifiable consumer request does not require you to create an account with us. Additionally, you will need to describe your request with sufficient detail to allow us to review, understand, assess, and respond. personal information collected from an individual to determine whether a request is a verifiable consumer request may not be used for any other purpose. We will endeavor to respond to a verifiable consumer request within forty-five (45) calendar days of receipt, but we may require an extension of up to forty-five (45) additional calendar days to respond and we will notify you of the need for the extension.
If you have an account with us, we will deliver our written response to that account. If you do not have an account with us, we will deliver our written response by mail or electronically, at your option. Any disclosures we provide will only cover the 12-month period preceding the receipt of your verifiable consumer request. The response we provide will also explain the reasons we cannot comply with a request, if applicable. To the extent permitted by the CCPA, we will respond to no more than two requests during any 12-month period.
You may authorize a natural person or a business registered with the California Secretary of State to act on your behalf with respect to the right under this CA Policy. When you submit a Request to Know or a Request to Delete, unless you have provided the authorized agent with a qualifying power of attorney, you must provide your authorized agent signed written permission to act on your behalf, verify the authorized agent’s identity with us, and directly confirm with us that you have provided the authorized agent permission. We reserve the right to deny requests from persons or businesses claiming to be authorized agents that do not submit sufficient proof of their authorization.
Notice to Site Users Located Outside the U.S.
The Company operates in accordance with the laws of the U.S. When you access our Site from outside the U.S., we may transfer the personal information that we collect from you to a location outside of your jurisdiction, including the U.S. The data protection laws in these jurisdictions may not provide you with the same protections as those of your jurisdiction. By using this Site you acknowledge that these laws may provide a different standard of protection and you consent to the transfer of your personal data to other jurisdictions, including the U.S.
